These Terms of Service ("Terms") govern your access to and use of the ZestyClip website and service (the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
ZestyClip is a free, browser-based tool that allows users to extract and download publicly available video content from Facebook and Instagram links. We do not host video files; we facilitate access to videos that are already publicly accessible.
2. Eligibility
You must be at least 13 years old to use the Service. By using ZestyClip you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Acceptable Use
You agree to use the Service only for lawful purposes and only with content for which you have the right to download. You must not use the Service to:
- Download or distribute content that infringes copyright, trademark, or any other intellectual-property right.
- Bypass any login wall, paywall, or other access restriction.
- Re-upload, republish, or commercially exploit downloaded content without the rights-holder's permission.
- Submit automated, abusive, or excessively high-volume requests, or attempt to disrupt the Service.
- Use the Service in violation of any applicable law, the terms of Facebook, Instagram, or any third-party platform.
4. Intellectual Property
All videos accessible through the Service are the property of their respective owners. ZestyClip claims no ownership over any user-submitted link or downloaded video. You are solely responsible for ensuring you have the right to download and use any content you obtain through the Service.
5. No Warranty
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific video will be downloadable. Facebook and Instagram may change their systems at any time, which may affect functionality.
6. Limitation of Liability
To the fullest extent permitted by law, ZestyClip and its operators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the Service.
7. Indemnification
You agree to indemnify and hold harmless ZestyClip, its operators and affiliates from any claim, demand, loss, or damage (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right, including intellectual-property rights.
8. Third-Party Services
The Service interacts with content hosted by Facebook, Instagram, and their CDNs. ZestyClip is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. Your use of any third-party service is governed by that service's own terms.
9. Changes to the Service or Terms
We may modify the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms.
10. Termination
We may suspend or terminate access to the Service at any time, with or without cause and without notice, including for violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Any dispute will be resolved in the competent courts of that jurisdiction.
